1. Introduction and Acceptance
Welcome to HomeBooktz ("HomeBooktz," "we," "us," or "our"). These Terms and Conditions of Service ("Terms") govern access to and use of the HomeBooktz cloud-based business management and accounting platform, including its website, software modules, APIs, integrations, reports, support services and related services (collectively, the "Platform").
By registering for an account, subscribing to a plan, accessing or using the Platform, you ("Customer," "you," or "your") agree to these Terms. If you accept these Terms on behalf of a company, organization or other legal entity, you represent that you have authority to bind that entity.
If you do not agree to these Terms, do not create, access or use a HomeBooktz account.
2. Definitions
Platform: the HomeBooktz software, website, APIs, integrations, reports, modules and associated services.
Customer/Subscriber: the person or legal entity that creates or maintains a HomeBooktz subscription and is responsible for the Tenant account.
Tenant: a separate business workspace/account operating within the multi-tenant HomeBooktz environment.
User: an individual authorized by the Customer/Tenant to access the Platform.
Branch: a business location configured under a Tenant account.
Customer Data: data entered, uploaded, generated or processed for the Customer/Tenant through use of the Platform.
Subscription Plan: the HomeBooktz service tier selected by the Customer, including Starter, Professional or Enterprise.
3. Description of the Platform
HomeBooktz is a cloud-based, multi-tenant business management and accounting platform designed to support operational and financial management. Depending on the Tenant's business nature, subscription plan and enabled features, the Platform may provide:
- General Ledger and accounting tools;
- Sales and CRM;
- Procurement and inventory management;
- Customer and supplier management;
- Multi-branch operations;
- Business and financial reporting;
- HR and Payroll functionality where available;
- Payment processing and subscription-payment support through available third-party providers;
- Industry-specific workflows; and
- Loan/Microfinance management functionality, including borrower, group, guarantor, collateral, application, approval, disbursement, repayment and related accounting workflows.
Features may vary by subscription plan, business nature, branch configuration, product development, integrations and applicable limits. HomeBooktz may introduce, modify, improve, suspend or discontinue features subject to applicable law and these Terms.
4. Business Natures and Industry-Specific Workflows
HomeBooktz may support business natures including, but not limited to, Electronics, Pharmacy, Supermarket, Hardware, Bookstore, Restaurant, Fashion, General Trading and Loan/Microfinance. Industry-specific functionality is intended to help manage records and workflows; it does not transfer the Customer's legal, regulatory, professional or operational responsibilities to HomeBooktz.
Customers are solely responsible for ensuring that their business activities, products, services, staff, taxation, licensing, inventory practices, lending activities and other operations comply with applicable laws and regulations in their jurisdiction.
5. Subscription Plans, Usage Limits and Billing
5.1 Current Plans
Prices are quoted in Tanzanian Shillings (TZS) as the primary currency. An equivalent US Dollar (USD) amount may also be displayed for reference, converted using the prevailing exchange rate at checkout. The current commercial plan structure in the source Terms is:
- Starter Plan - TZS 15,000/month: General Ledger and Accounting, Basic Sales and CRM, Procurement and Inventory, Sales Reports, up to 2 users, and up to 100 transactions per month.
- Professional Plan - TZS 30,000/month: Starter features, expanded Sales/Inventory/Customers and Suppliers reporting, up to 2 active branches, up to 5 users, and up to 1,000 transactions per month.
- Enterprise Plan - TZS 60,000/month: Professional features, Full Report View Access, Advanced Reporting, Unlimited Branches/warehouses, Unlimited Users, Unlimited Transactions, and a Dedicated Account Manager.
These plan descriptions are subject to the plan shown at checkout or in the Customer's active subscription record. HomeBooktz may change plan features, limits or pricing prospectively, subject to applicable law and any required notice.
5.2 Usage Limits
Customers must operate within the transaction, branch, user, module and other limits applicable to their subscription. Where a limit is reached, HomeBooktz may require an upgrade, restrict the affected feature, or apply another commercially disclosed treatment.
5.3 Upgrades and Downgrades
Plan changes may take effect immediately or at the next billing cycle, as specified during checkout or within the Platform. Where applicable, upgrade charges may be prorated.
5.4 Subscription Payments
Subscription fees are billed according to the selected billing cycle. Payments may be processed through third-party payment providers supported by HomeBooktz. The Customer authorizes the selected payment provider to process the applicable subscription payment. HomeBooktz may rely on verified payment confirmations, including provider callbacks or webhooks, to activate or renew a subscription.
Except where required by applicable law or expressly stated by HomeBooktz, subscription fees are non-refundable. Failed, reversed, disputed or overdue payments may result in non-renewal, suspension or termination after any applicable grace period.
5.5 Invoices and Receipts
HomeBooktz may generate subscription invoices, receipts and payment records based on payment information received and verified through the applicable payment process. Third-party payment providers may maintain separate transaction records.
6. Account Registration and Tenant Separation
Each Tenant is intended to operate as a logically separated business workspace. Customers must provide accurate registration information and must not intentionally create accounts or configurations designed to circumvent subscription limits or access another Tenant's data.
Customers are responsible for maintaining correct branch configuration and for ensuring that Users are assigned only to the appropriate Tenant and Branch.
7. Users, Roles and Access Control
Customers are responsible for creating, approving, managing and removing User access and for assigning appropriate permissions. This includes promptly disabling access for persons who no longer require access.
The Platform may support role-based access, branch restrictions and audit records. Customers remain responsible for configuring permissions appropriately and for reviewing sensitive financial, payroll, inventory, customer and loan-related access.
8. Customer Data and Ownership
The Customer retains ownership and applicable intellectual property rights in Customer Data entered, uploaded or processed through the Platform, subject to the rights and permissions necessary for HomeBooktz to provide, maintain, secure, support and improve the Platform.
HomeBooktz does not acquire ownership of Customer Data merely because it is stored or processed through the Platform.
The Customer is responsible for the legality, accuracy, completeness and appropriateness of Customer Data and for having the necessary rights, notices, permissions or lawful basis to provide such data to HomeBooktz.
9. Privacy and Personal Data
HomeBooktz may process personal and business information necessary to provide the Platform, including account details, User information, customer records, supplier records, employee/payroll information and, where applicable, borrower, guarantor and collateral information.
HomeBooktz will handle personal data in accordance with its applicable Privacy Policy and applicable data-protection requirements. Customers must use the Platform in a lawful manner and must not upload personal information they are not authorized to process.
Where a Tenant stores identity documents, borrower information, employee information, medical/pharmacy-related operational records, financial information or other sensitive information, the Customer remains responsible for lawful collection, accuracy, access control and use of that information.
10. Accounting, Financial, Tax and Operational Responsibility
HomeBooktz provides software tools for double-entry accounting, journals, ledgers, reporting, inventory-related accounting, payment records and business management. HomeBooktz is not a certified public accounting firm, tax advisory service, legal counsel, auditor, financial institution or lender.
The Customer is responsible for reviewing and approving its accounting configuration and records, including Chart of Accounts, tax settings, transaction classifications, journal entries, inventory valuation policies, payroll information, financial reports and other outputs.
Automated accounting postings are software-generated records based on configured workflows and transaction data. Customers must review material financial transactions and reports and obtain professional accounting or tax advice where required.
HomeBooktz does not guarantee that reports, tax calculations or accounting outputs will satisfy a particular regulator, auditor, tax authority or accounting standard unless expressly agreed in writing.
11. Loan/Microfinance Tenant Disclaimer
Where the Loan/Microfinance tenant is enabled, HomeBooktz provides software functionality for managing loan applications, borrowers, groups, guarantors, collateral, approval/rejection workflows, disbursement, repayment schedules, repayments, arrears, loan status and related accounting records.
HomeBooktz is a software provider and does not itself lend money, guarantee repayment, approve a borrower's creditworthiness, collect a debt on behalf of the Customer, or make lending decisions for the Customer.
The Customer is solely responsible for compliance with applicable lending, microfinance, consumer-protection, interest-rate, fee, collections, identification, recordkeeping, licensing and regulatory requirements.
Loan processing fees, interest, principal, repayments and other amounts shown by the Platform are subject to the Customer's configured products, policies and applicable law. The Customer must verify loan terms and financial records before approval, disbursement and collection.
12. Pharmacy Tenant
Where Pharmacy functionality is enabled, the Platform may support medicine inventory, expiry-related controls and sales workflows. The Customer remains solely responsible for lawful sourcing, storage, handling, dispensing, sale, expiry management, disposal, licensing and regulatory compliance. HomeBooktz does not provide medical advice or guarantee the suitability, safety or legality of any medicine or pharmacy operation.
13. Restaurant Tenant
Where Restaurant functionality is enabled, the Platform may support raw-material purchasing, ingredient availability, recipes, kitchen production, finished menu items, combos, customer orders, dine-in or delivery workflows, serving and payment records.
The Customer remains responsible for food safety, preparation, recipes, allergens, nutritional information, licenses, staff practices, delivery, customer service and compliance with applicable health and food regulations. HomeBooktz does not provide food-safety or medical advice.
14. Other Industry Responsibilities
For Electronics, Hardware, Supermarket, Fashion, Bookstore, General Trading and other business natures, the Customer remains responsible for product legality, warranties, pricing, tax treatment, inventory controls, supplier relationships, customer obligations, licenses and industry-specific regulatory requirements.
HomeBooktz provides software tools and does not assume the Customer's underlying commercial or regulatory obligations.
15. Customer Responsibilities and Data Accuracy
- The Customer must provide accurate and complete information where required.
- The Customer must verify the accuracy of financial, inventory, customer, supplier, employee and loan records.
- The Customer must maintain appropriate internal controls and approval procedures.
- The Customer must review material reports and financial postings.
- The Customer must maintain appropriate User permissions.
- The Customer must keep its own required business records and comply with applicable retention obligations.
16. Payment Processing and Third-Party Integrations
HomeBooktz may integrate with payment gateways, banks, mobile-money providers, email/SMS providers, hosting providers and other third-party services. Third-party services are subject to their own terms, fees, availability, privacy practices and technical requirements.
HomeBooktz is not responsible for a third party's outage, rejected transaction, delayed settlement, account suspension, policy decision, API failure, network failure or other act or omission outside HomeBooktz's reasonable control.
A payment should be treated as completed in HomeBooktz only when the applicable payment status has been successfully verified through the supported payment process.
17. Security and Account Credentials
Customers and Users must protect login credentials, authentication devices and access information. Customers are responsible for activities conducted through their accounts, except to the extent caused by HomeBooktz's proven failure to meet an applicable legal or contractual obligation.
Customers must promptly notify HomeBooktz of suspected unauthorized access, credential compromise or security incidents affecting the Platform account.
18. Audit Trail and Financial Record Integrity
The Platform may record audit information relating to logins, record creation, edits, approvals, rejections, financial transactions, payments, reversals, configuration changes and other User actions.
Audit records may be retained for security, compliance, dispute resolution, operational and financial-control purposes and may not be available for deletion or modification by ordinary Users.
19. Intellectual Property
HomeBooktz retains all rights, title and interest in the Platform and its software code, architecture, UI, designs, trademarks, logos, documentation, feature sets and other proprietary materials, except for Customer Data and third-party materials.
Subject to these Terms and payment of applicable fees, HomeBooktz grants the Customer a limited, non-exclusive, non-transferable, revocable right to access and use the Platform for the Customer's internal business purposes during the active subscription.
Customers must not copy, resell, sublicense, reverse engineer, decompile, extract source code from, or create derivative works of the Platform except where such restriction is prohibited by applicable law.
20. Acceptable Use
Customers must not use the Platform to:
- conduct fraudulent, illegal or unauthorized financial transactions;
- launder money, facilitate fraud or falsify business or financial records;
- submit fraudulent loan applications or manipulate loan records for unlawful purposes;
- gain unauthorized access to another Tenant, Branch, User or Customer's data;
- rent, sell, lease or sublicense Platform access except as expressly authorized in writing;
- reverse engineer or attempt to extract source code or security mechanisms;
- upload malicious code or content intended to disrupt or compromise the Platform; or
- violate applicable laws, regulations, third-party rights or these Terms.
21. Service Availability, Maintenance and Changes
The Platform is provided as a hosted service and may be unavailable from time to time due to maintenance, upgrades, security measures, infrastructure problems, third-party service failures, internet connectivity or circumstances beyond reasonable control.
HomeBooktz may perform scheduled or emergency maintenance and may modify technical architecture, interfaces, workflows and features as the Platform develops.
Unless a separate written service-level agreement applies, the support descriptions in the Customer's plan are service descriptions and do not constitute a guarantee of uninterrupted availability.
22. Backups, Data Export and Recovery
HomeBooktz may maintain backups as part of its operational and disaster-recovery practices. Backups are not a substitute for the Customer maintaining any records that it is legally required to retain.
Customers should periodically export important business information where appropriate. HomeBooktz does not guarantee that every record can be restored to every historical point in time following an incident.
23. Reports and Business Decisions
Reports and dashboards are generated from data and configurations available within the Platform. Customers are responsible for reviewing reports before relying on them for accounting, tax, lending, inventory, payroll, management or other material decisions.
HomeBooktz does not guarantee business outcomes, profitability, increased sales, successful loan collection, reduced losses, tax savings or other commercial results.
24. Confidentiality
Each party should protect confidential information received from the other party and use it only for legitimate purposes connected with the Platform or business relationship. Confidentiality obligations do not apply to information that is public without breach, already lawfully known, independently developed, or required to be disclosed by law or lawful authority.
25. Warranties and Disclaimer
To the maximum extent permitted by applicable law, the Platform is provided on an "AS IS" and "AS AVAILABLE" basis. HomeBooktz disclaims warranties not expressly stated in these Terms, including implied warranties of merchantability, fitness for a particular purpose and non-infringement, to the extent such disclaimers are permitted by law.
Nothing in these Terms excludes or limits a liability that cannot lawfully be excluded or limited.
26. Limitation of Liability
To the maximum extent permitted by applicable law, HomeBooktz will not be liable for indirect, incidental, special, consequential or punitive damages, loss of profits, loss of anticipated savings, business interruption, loss arising from third-party services, or losses caused by inaccurate Customer Data, unauthorized User activity, Customer configuration errors or failure to review financial records.
Any monetary limitation of liability, if adopted, should be confirmed by legal counsel and aligned with applicable law and any separate service agreement.
27. Indemnification
To the extent permitted by applicable law, the Customer is responsible for claims, losses, penalties, liabilities and reasonable costs arising from the Customer's unlawful use of the Platform, breach of these Terms, infringement of third-party rights, unauthorized processing of personal data, or business operations conducted through the Platform.
This section should be reviewed by legal counsel before publication to ensure the intended scope and enforceability under applicable Tanzanian law.
28. Suspension and Termination
The Customer may cancel a subscription in accordance with the cancellation process made available by HomeBooktz.
HomeBooktz may suspend or terminate access where reasonably necessary for non-payment, material breach of these Terms, security risks, unlawful use, abuse of the Platform, or other grounds permitted by applicable law.
Where practical, HomeBooktz may provide notice and an opportunity to remedy a breach before termination, except where immediate action is reasonably necessary.
29. Data Export and Deletion After Termination
Following termination, the Customer will have 30 calendar days to export available Customer Data, unless a different period is required by law or agreed in writing.
After the applicable export period, HomeBooktz may delete or anonymize inactive Tenant data from active systems, subject to legitimate retention requirements, backups, security logs, accounting records or other lawful obligations.
Deleted information may remain temporarily in backup systems until those backups are overwritten according to applicable retention processes.
30. Changes to These Terms
HomeBooktz may update these Terms from time to time. Updated Terms may be published through the Platform or website. Where legally required, HomeBooktz will provide appropriate notice. Continued use of the Platform after the effective date of updated Terms constitutes acceptance to the extent permitted by law.
31. Governing Law and Dispute Resolution
These Terms should be governed by the laws of the United Republic of Tanzania, subject to any mandatory legal requirements applicable to the Customer or transaction.
The parties should first attempt in good faith to resolve disputes through direct discussion. If a dispute cannot be resolved, it may be referred to the competent courts or another dispute-resolution mechanism agreed by the parties, subject to applicable law.
This clause should be reviewed by a Tanzanian legal professional before publication to confirm the appropriate jurisdiction, venue and dispute-resolution mechanism.
32. General Provisions
- These Terms, together with any applicable order, subscription details, Privacy Policy and separately agreed service terms, form the agreement governing use of the Platform.
- If any provision is held invalid or unenforceable, the remaining provisions will continue to the extent permitted by law.
- A failure to enforce a provision does not constitute a waiver of that provision.
- The Customer may not assign the subscription or its rights under these Terms without HomeBooktz's prior written consent, except where applicable law provides otherwise.

34. Customer Acknowledgement
By creating an account, subscribing to a plan, clicking an acceptance checkbox, or otherwise accessing or using the Platform, the Customer acknowledges that it has had an opportunity to review these Terms and agrees to be bound by them.
For business subscriptions, the person accepting these Terms represents that they are authorized to accept them on behalf of the relevant business or legal entity.
